1. Regulations we build against
- Waste (England and Wales) Regulations 2011 — Regulation 12 (waste hierarchy) + Regulation 35 (transfer notes).
- Environmental Protection Act 1990 — Section 34 Duty of Care.
- Hazardous Waste (England and Wales) Regulations 2005 — consignment-note record-keeping.
- UK Digital Waste Tracking service (DEFRA, effective 2026) — API submission of every waste movement.
2. How each WTN satisfies the law
| Legal requirement | Where in the product |
|---|---|
| Description of waste (EWC code + words) | Multi-select EWC picker + free-text description on the driver app |
| Quantity | Gross / Tare / Nett weights captured in kg, auto-computed and PDF-stamped |
| Type of container | Load-type dropdown (8-Wheel Tipper, Grab Lorry, Skip Lorry…) |
| Time & date of transfer | Server-stamped on signing, also captured as arrival + departure for time-on-site |
| Place of transfer | Collection point + delivery address carried from the job, plus GPS captured on sign-off |
| Names + addresses of transferor & transferee | Tenant company block (left) + customer block (right) on the PDF |
| SIC code | Stored on customer record, printed on every WTN |
| Duty of Care declaration (Reg 12) | Mandatory checkbox + printed blue band on every PDF |
| Signatures of both parties | Sign-on-glass pads for driver + site operator, stored as base64 PNGs and embedded in the PDF |
| Carrier registration number | Pulled from tenant settings, printed on every PDF |
| 2-year retention | WTN records are soft-deletable only; hard delete blocked at the API layer |
| DEFRA Digital Waste Tracking submission | One-click Submit to DWT on every WTN; preview mode until your API keys are added |
| Void / correction audit | Every edit & void logged with timestamp, user, reason, and from/to diff; VOIDED watermark on the PDF |
3. Who carries the legal responsibility
You do. We’re a tool, not a licence. You remain the registered waste carrier and the data controller for your waste records. We make it easier to do the right thing — we don’t make you compliant by magic.
4. DEFRA Digital Waste Tracking readiness
- We build against DEFRA Receipt of Waste API v1.0.
- Every WTN can be submitted in preview mode today and flipped to live as soon as DEFRA publishes the endpoint URL.
- Submission status (preview / live / failed) shown on every note, plus a tenant-wide readiness widget.
- Runbook available on request — see
DWT_GO_LIVE.mdin our docs.
5. Hazardous waste
Hazardous EWC codes (with the * suffix) are flagged in the catalog. Full Hazardous Waste Consignment Note workflow is on the roadmap for 2026 Q3. Until then, record hazardous movements alongside your current consignment-note process.
6. Data retention
See Privacy Policy § 4. Minimum 2 years on WTNs, 3 years on hazardous movements, 7 years on billing records.
